Proper Diaper Pail Use. Client shall not include any items other than the cloth diapers, wipes, covers and other rented supplies inside the diaper liners returned to Tinkle Belle for service. Client is responsible for any and all damage caused by Other Items to the diapers, the cleaning machines, or any other property or personnel of Tinkle Belle. Tinkle Belle is not responsible for loss of or damage to Other Items left by Client in the diaper pail.
Vacation Holds & Paper Diaper Substitute Option. In the event that you will be away from service, Tinkle Belle will replace your cloth diapers with paper diapers at no additional cost.* Client must give at least three (3) calendar days notice for this switch. Client must provide written notice of travel start & end dates to Tinkle Belle.
*Quantities of paper provided will be calculated based on your service price.
If client is going out of town & will miss delivery day, arrangements must be made in advance for Tinkle Belle to collect soiled diapers.
If pick-up and delivery day falls on a holiday, Tinkle Belle will notify Client in advance of any special holiday delivery schedule.
Cancellation. Client may cancel the service by providing at least two (2) calendar weeks’ written notice of cancellation from the final pick-up. You may cancel anytime after the minimum commitment of 12 weeks has been met. Notice of cancellation must be delivered to Tinkle Belle by mail to P.O. Box 283, Los Alamos, CA 93440, or by email to firstname.lastname@example.org.
We’ll pick up the following items at your last pick-up: diaper pail, pail liners, cloth diapers, covers, doublers, fitteds, potty pants, etc. We’ll take inventory of all items returned and provided that everything is returned, no further charges will be incurred. If items are not returned on your final pick-up, they must be dropped off at our office within 1 week or pay a $15 fee for us to return the following week to pickup. Any unreturned inventory will be charged to your card at prices as detailed in this Agreement. If you wish to keep any items, please notify us and we will charge your account.
Client is responsible for any loss, damage, or theft of the diaper pail, cloth diapers, and diaper pail liners left unattended for pick up or delivery.
Replacement Fees. The replacement fee for damaged or unreturned items are as follows:
Diaper Pail: $28.00, Cloth Diaper Pail Liner: $17.00, Prefold Cloth diaper: $2.00; All In One Diaper: Newborn $10, One Size $15.00, Rental Diaper Cover: $8.00. Fitted Diaper: $8.50. Cloth Wipe: $1.00. Doubler: $2. Potty Pants $4
Refunds. Tinkle Belle does not offer refunds on used goods or prepaid services. Funds originally directed towards services that will not be used may be put towards goods or a gift certificate. Tinkle Belle has no obligation to refund any amounts paid by Client.
This Diaper Laundering and Delivery Services Agreement (this “Agreement”) is entered into by and between Client and Tinkle Belle Diaper Service LLC (“Tinkle Belle”). Subject to the terms and conditions of this Agreement, the parties agree as follows:
Services. During the service term, Tinkle Belle shall provide to Client cloth diaper rental, laundering, and pick-up and delivery services as follows and as otherwise may be detailed in this Agreement. The service term is four consecutive weeks. The Initial Service Date begins on the date that diaper use begins.
Minimum Service Period. Client agrees to a minimum service period of twelve (12) weeks from the start of service. Please make sure that you are able to commit to the minimum service period before signing this membership form as there will be no refunds, paper diaper substitutions or store credit for the minimum service period once you have received your diapers. Please keep in mind that we have factored in time, labor hours & overall effort to set-up your account, which is why the 12 weeks are not refundable or transferable. Thank you for understanding.
Billing. Automatic Reoccurring Billing (ARB) Terms: For each four-week term of service, Client shall pay to Tinkle Belle the service fee as set forth in this Agreement. Payment for the initial 4 weeks of service is due immediately upon execution of this Agreement. Additional services & products may be added on at the in-home consultation appointment or at any time while you are a current customer. The term automatically renews after 3 weeks of active diaper service & every 4 weeks thereafter. Each payment entitles you to 4 weeks of service, unless otherwise noted on the invoice. Tinkle Belle Diaper Service will charge your credit/debit card every 4 weeks until a cancellation request is received.
Holding Unused Items. Client may not hold unused items for a period longer than 2 weeks post-birth. A weekly rental fee of $10 for Prefold Service, $20 for ½ & ½ Service and $30 for AIO Service will apply to each week thereafter.
Rental. Tinkle Belle rents to Client one diaper pail for use throughout the duration of the service term, a reusable pail liner on a weekly basis, and reusable cloth diapers on a weekly basis. The diapers will be of the size and in the quantity as outlined on Services page at www.tinklebellediaperservice.com. All rental items will remain the property of Tinkle Belle and must be returned to Tinkle Belle promptly upon cancellation of the services.
Diaper Counts. Your 1st two drops of supplies will include the following, based on your service selection: 80 Prefolds / 80 All In Ones / 40 Prefolds & 40 All In Ones / 40/80/120 Wipes / 40 Prefolds & 32 Disposables / 40 All In Ones & 32 Disposables. From this point forward, Tinkle Belle will count the dirty supplies picked up & drop that amount the following week, unless otherwise requested.
To ensure your counts are accurate, only place soiled items in your diaper pail liner. Keep all clean items at home. If you have arranged for a change in size or service, place any clean items that you are returning in a separate, clean bag.
To ensure that you don’t run short on inventory, please give us at least 2 days to be added to the delivery route or to make changes to your delivery.
We will provide additional prefold diapers at no extra cost. Extra sets of 20 All In One diapers will be charged $12.00/week. Additional sets of 7 doublers are $2.50/week, additional sets of 7 fitted diapers are $3.99. Additional pail liners are available at a rate of $1.50/week. If you request a mid-week drop off & an additional delivery is possible, the fee is $15.00 per trip.
Order Modification. Client may modify an order (e.g., sizes, quantities, add-on & supplies) by giving three (3) business days’ written notice to Tinkle Belle prior to delivery. Upon an order modification of diaper style, Client must return all current diapers in order to receive a full supply of the next style. Client will be charged the replacement fees indicated in this Agreement for all unreturned diapers.
Missed Pick-Ups. In the event that Client fails to properly leave the soiled diapers out for pick-up, Tinkle Belle will still leave a clean bundle for Client. For any missed pick-ups, client may drop diapers to Tinkle Belle office in Solvang, Tinkle Belle will pick up two weeks’ worth of diapers the following week, or client may schedule an additional pick-up for a $15 fee (subject to availability). If Client forgets to leave the soiled diapers out a second week in a row, Tinkle Belle will not leave any diapers and Client must call Tinkle Belle to schedule an extra pick-up for an additional fee of $15.00 per trip.
Proper Diaper Use. Client must only use the Tinkle Belle rental diapers as provided by this Agreement. Improper use may damage the diaper and require its removal from service. In the event that Client’s improper use of a diaper requires the diaper to be removed from service, Client will be charged the replacement fee as indicated in this Agreement.
Diaper Storage. Client must not store soiled diapers in sealed plastic, in the heat, or in direct sunlight.
Diaper Ointment. Certain medications or diaper creams can cause untreatable barriers that ruin the diapers’ absorbency. For this reason, Client must use a pre-approved cloth diaper safe cream on the rented diapers, as well as on the baby’s bottom when using the rented diapers. Liners must be used with any other ointments or medications. Client will be responsible for cost of damaged goods per this Agreement.
Information Privacy. Tinkle Belle will only use Client’s information for the purpose of contacting Client concerning the service. Tinkle Belle will not sell or share Client’s information with any third parties. If Client would like its information removed from our system, a written request must be made to Tinkle Belle by mail to P.O. Box 283, Los Alamos, CA 93440, or by email to email@example.com.
Limitation of Liability. Tinkle Belle’s liability under this Agreement shall be limited to general money damages in an amount not to exceed the charges paid by Client during the service term(s) during which the event(s) giving rise to liability occurred. The preceding statement of liability shall be the extent of Tinkle Belle’s liability regardless of the form in which any legal or equitable action may be brought, and the foregoing shall constitute Client’s exclusive remedy.
Prior to the Services Start Date, Client must inform Tinkle Belle of any and all allergies that Client knows or has reason to believe that Client’s baby has. Tinkle Belle will not be held liable for any adverse reactions that may occur as a result of using any of the products supplied to Client by Tinkle Belle.
Client Satisfaction. Tinkle Belle strives to meet the satisfaction of all of its clients. Tinkle Belle welcomes all comments and questions, and will attempt to remedy any situations brought to our attention. Tinkle Belle rigorously cleans all rented diapers to ensure ultimate cleanliness and the best possible product and service for Client’s baby. Tinkle Belle welcomes any inquiries about the washing process, including the products used.
Tinkle Belle reserves the right to terminate this Agreement at any time.
Entire Agreement. This Agreement, including any and all Exhibits referred to herein, constitutes the complete, exclusive, and entire agreement between the parties, and may not be modified except in writing signed by both parties.
